[The undercover police officer] knocked on the door of the residence, which was answered by Found’s wife. [The officer] explained he was trying to find a certain residence and thought it was the Found home. He alleged that Found’s wife invited him into the house to look at a phone book. That’s when [the officer] alleges he smelled burnt marijuana and a “musty” smell.

He returned on March 6 with a search warrant, where he spoke with Found about the smell and the tank. Upon executing the warrant, he found a “concealed growing room,” which had growing lights and paraphernalia.

The charge that resulted from the search warrant that the officer got was thrown out by a judge, who would not even certify it to the grand jury.
