Paypal account with vanilla Visa
I wondered about Paypal requiring the account to be "Verified"...How do you do that with a Vanilla Visa gift card?
Does the card have to be registered in some way??

"Vanilla" won't work--PayPal ties you to a real bank account.

Annonymous phone & etc.
It's called K7 dot net.....
You simply get an anonymous email account like hidemyass dot com....and use that to receive your phone messages.
Or, just log in to K7 and monitor the messages from there.
Let me know what you think

Here is why you should title your car in the name of an LLC
Hello group, I was reading an article on yahoo news which made me proud in knowing that if my company vehicle plate was ever recorded, all that would be known is that it belongs to a company not an individual.
Thanks JJ Luna for sharing this remarkable tool !

Phone & Fax
Anyone have any ideas about how to get a phone answering & fax receiving service that is totally annonymous?
I have found one where you can use an anonymous email address & they will give you a number that will record faxes & voice messages and send them to the email address.
Totally anonymous & free.
I hesitate to provide the site...only because I would like to hear from others as to the safety of such a thing.

RE: 9612. Using Paypal
Actually, I have been using Vanilla Visa gift cards tied to a Paypal account associated with a ghost name and address to buy items over eBay for years. When the gift card runs out, I clear the card number and enter the number of a fresh card. Never had a problem.
However, I think if you want to purchase something over a certain amount it has to be associated with a bank account. I never had to make that big of a purchase though.

Owning and renting properties via LLCs
I suppose that using a NM LLC to own property in Ireland might be possible, in principle, but useless in fact, as the company owner should always disclose his identity.
My question, however, is about owning property in the USA. eBay lists a certain number of underpriced houses, generally in Detroit, and I was considering the feasibility of buying one or more for renting them.
(I'm writing a new post here but you can add this to my previous question, if you want)

Search/Seizure Rights & Personal Privacy Awareness
I think the linked video brings up a few valid points in regards to the privacy concerns of which you often speak:
1) the quasi police state in which we live,
2) how most people would be unaware of their rights in this situation, and
3) his awareness of not wanting his personal information permanently in a police report
I think I can hear your response already, Jack. "What is better is to not have interactions with the police in the first place. Maybe consider not displaying a firearm in public." Agreed.

How to Register Your Car In PA using a NM LLC
This state is very easy as long as you have all of your paper work ready and in order. The first thing you must do is purchase the vehicle in the name of your LLC, or if already purchased, transfer title in the name of your LLC.
Your insurance card, title,and Articles of Organization should all bear the name of your NM LLC. There exists a "fact sheet" that describes the various documents that you can supply to validate the existence of your LLC. For simplicity I chose the following;
The LLC's operating agreement and a "Letter of Authority". You must do your own "due diligents to find a free operating agreement, and bright enough to "write your letter of authority".(No Brainers)
With form MV-140 filled out in section A with the name of the NM LLC (and none of your personal info filled in)you are good to go ! They will ask to see your drivers license but that is to only verify that you are the "authorized agent" that is expressed in your "Letter of Authority". You will sign "as agent". Good Luck 2 Ya

wiping iphone with no itunes account
My iphone went dead, because of not synching. I want to wipe it, but believe it has to be working to do this. I don't have an itunes account and don't want, after reading about itunes and spyware, to synch itunes with my iphone.( I have never even once synched it, and eventually it just died).
Even if I opened an account with a gift card and used a fake name, my real name etc. is all over the phone. I don't know if Apple can wipe a dead iphone, and if they can, if they also synch it to something, thus getting the phone's contents. It seems in order to keep the phone private (by wiping it), you'd have to make the contents available/not private by way of itunes. Thanks for any ideas.

Owning and renting properties via LLCs
Among the activities that do not constitute doing business for an LLC, there is owning real estate "whith no more". This means that renting property would mean doing business. What about if the LLC owns the property and a third party (individual or entity) rents it, upon agreement with the LLC's owner? Thanks.

UPS access to USPS database
I ordered merchandise from a mail order company and asked them to use USPS to deliver it to my post office box, but they mistakenly used UPS. I called and asked the company to contact UPS and have it redirected to a local UPS store where I could pick it up, but it turned out they never did.
I checked online and found that UPS had left my package on a "porch". (Not my porch, though. I never receive deliveries at home, for reasons that should obvious to readers here.) Hoping that meant that the package was at my post office waiting for me, I rushed off to pick it up --- but it wasn't there.
I called UPS and they told me that the package had been delivered to my ghost address. Since I've never used that address for deliveries or shared it with UPS or the company I ordered from (or anyone else besides the DMV and the USPS), I had to conclude that UPS obtained it from one of those two sources, most likely the USPS.
This could have been really bad for me, but I was in luck this time because my ghost address is at a friend's house. However, had this happened last year before I updated my P.O. Box application, this package would have gone to an apartment that I haven't lived in since the early 00's. Probably I would have received the package anyway, because that apartment is quite close to my post office. But what if I had moved hundreds of miles away in the meantime?
But consider this: If you're a stalker/criminal/family member/whatever, and you know someone with a post office box whose street address you want to obtain, this would be a fantastic way to get it: Just ship a UPS package to their P.O. Box address, wait for delivery, then call UPS and ask for the street address it was delivered to. (!)
I questioned the postal clerk about UPS deliveries to P.O. Boxes, and she affirmed that USPS does in fact accept such deliveries, but ONLY if the package is addressed to the receiver's post office street address. Otherwise UPS either holds it at their warehouse, or attempts to deliver it to your street address.
As a precaution from now on, I intend to give mail order companies my post office box street address (followed by my box number) for delivery, in case such a mistake ever happens again.

#9598 Your Tax Bill Is Public
Tax bills are public, but many counties allow you to submit a form to have your name taken off of the public sites, replacing your name with something like "Current Owner". Check your county's appraisal district website to see if your name appears (if you own property).

Passports
I'm aware that you warned that a U.S. passport may become more problematic to obtain back in a later 2012 blog post.
It appears that the State Department and/or OMB has not yet worked out whether the proposed form will be approved.
In other words, it appears that the current (less intrusive) passport application is still the one in effect.
Any word (or maybe a reader knows?) how much longer we may have, or if State is even still pursuing the amended (comparatively intrusive) passport application format?

Probate is public
In my state (and probably many others) probate records are public and available to anyone in person or on the web, and include information such as list of assets and their value, names and addresses of heirs (including those who would have inherited if there was no will,) a copy of the will including who gets what, etc.
Trusts (revokable or irrevocable) or pay-on-death accounts might give privacy in other states but here in Maryland they must be reported in probate, since they are subject to state inheritance tax.
Not much privacy.

Safe deposit box privacy after death
My state (and a couple others) impose a tax on inheritances (1% or 10% depending on how closely related you were to the decedent.)
As a result, SD boxes are supposed to be sealed after one of the joint owners dies; possibly this also applies if someone who was authorized to have access dies. (Bank employee told me this, I haven't checked the law.)
It may be possible to get around this by 1)having the box rented by a corporation, LLC, trust, etc., 2)renting a box out of state, or 3)not having certain personal papers, photos or other items in the box.
I am not sure how this works in practice, especially in a large city where it would take time for the death certificate to be filed, probate to be opened, etc. before the bank even knew of the death. In a very small town, where everyone knows everyone, the bank would probably know right away.
Just something to be aware of if you live in certain states.

Re. 9586 - Separate ghost addresses
The original poster mentioned using an alternate name for 1) buying things online, 2) store loyalty cards and 3)hotel reservations.
For #1, if a physical product is being shipped, then it makes sense to use that address. If nothing is shipped (downloads for example) and for #2 and #3 I've used a made-up address since I have no interest in receiving junk mail from those companies.

your tax bill is public
I talked with a client with an unusual foreign name. After she hung up I realized I had missing info. Usually I don't look up people on line but I googled her name. Up popped two listings for PDF's of her and her husband's tax bills and the address, location, value of some property they own in Texas. Well, I have no need of this, but she is a doctor, for heaven's sake! It made me so upset I never opened the pdf's and wrote her for the info instead... What are we all facing here??? Why would a county publish people's property tax bill on line?!? Unbelievable.

Yes, it can be done by mail if you choose a county without emission requirements but you may not like one of the forms, not to mention photo ID.
I've been getting WA plates for various persons and can simplify the paperwork and present my own ID instead of yours. If this is of interest, contact me by email, please.

RE:9588, 2 way radios
You also forgot to mention the best two-way radio type of all- HAM (aka-amateur) radio! I understand many people have the misconception that HAM radio is too technical for them. The lowest level test for a license (technical class) is pretty easy, only 40 questions and no knowledge of Morse code is required. If you can pass a driver's test, you can pass this this test. With this license you could get a 2-meter VHF amateur transceiver and communicate by voice. Another plus if you have a family is HAM 's tend to be more civil and profanity is forbidden unlike CB radio.
BTW- Brian which brands do you suggest for the commercial radios.

Re #9583 two-way radios
I also miss that chapter on two-way radios, but I must say I agree with Mr. Luna that few people bother with them. Even the best radios out there seldom get a range of more than a mile or two, which just isn't enough for most people.
I recommend buying commercial equipment rather than the crappy bubble-wrap walkie-talkies from discount stores. The quality is much better and you can use them on the corresponding FRS, GMRS or MURS frequencies. You can get good used radios cheap from government surplus sales as government agencies replace their radios with digital equipment.
We have a base station, mobile radios in both of our cars and a couple of walkie-talkies. I feel much better prepared in case the power goes out for a long period or if the cellphone network becomes jammed during an emergency like it did in New York on 9/11.

I totally agree with your comments, Brian. The cheapie radios just don't have enough range. Marine VHF radios are better but not lawful to use on land. (I bought two anyway but will never use them unless everything else goes down.)

Separate ghost addresses?
Hello Mr. Luna. I read your book but I'm unlclear about using an alternate name. Do I need a separate ghost address for my other name?
The alternate name I plan to use is similar to my real name, but using my middle name in place of my last name. I'm worried about cross-contamination -- if my real name and my alternate name are associated with the same address, would they then become associated with each other?
I will mainly use my alternate name for buying stuff online but also for things like store loyalty cards and hotel reservations.
Thank you for offering this question and answer service.

Yes, using a separate address for an alternate name would definitely give you an extra layer of privacy.

CA DL
Recently learned that in CA you can have a P.O. BOX show up on the front of your DL concealing your "street" address. The only con of a CA DL is that they take a fingerprint and associate that with your DMV record.

Good Video
Was going through all your past Q&C (so much good stuff in the past) and wanted to revive this video that everyone should watch. This should be posted every few months for folks.
The video is a must watch now as it was in 2006...maybe someone else revived it between then and now...but I'm doing it again.
"BUSTED: The Citizen's Guide to Surviving Police Encounters
http://www.youtube.com/watch?v=7wfJDyxoOso
Now, this is not condoning some of the illegal activities portrayed in the video...frankly, anyone who does these things SHOULD get caught...BUT my concern for reviving the video is simply that we should be educated as to our rights against abusive, lying cops. That's it.

I debated deleting this post, not only because you failed to give your age (what does it matter?) but because I saw this video many years ago. The actor portraying the cop does not give an accurate portrayal of MOST law enforcement officers.
I'll allow it for now but take it down if I get some protests.

HTBI book differences
I just bought the HTBI third edition, and noticed that the section on handheld two-way radios from the previous edition is missing. Why was this eliminated, and are there any other things that have been removed that would encourage me to keep the previous edition? Thanks.

Most people never bother to get radios, and I needed the space for a new chapter.

ghost addresses
I am in an apartment for now. My Driver license stuff is needing to get done. I can't seem to find a local Ghost address. What is your opinion Signor Luna regarding simply giving the local DMV my apartment address (office street address) BUT conveniently leaving the unit number off? It is not as ideal as a complete Ghost address but better than nothing if it works?
Do most DMVs know if an address is either an apartment complex or CMRA?...
Thank you

Some do, some don't. States vary. Clerks have good days and bad days. Can't you use the address of a relative?
Sometimes you can get an out-of-state address on your DL by explaining that you are in that second state temporarily, but will return to the home state before the end of the year. Give it a try!

License Plate Readers
Just read a newspaper article that here in Maryland there are 371 license plate readers, at undisclosed fixed locations and in police cars that gather information that is stored for at least a year. The data is shared with other state and Federal agencies (unknown how long THEY keep it.) The agency gathering the data is called the Maryland Coordination and Collaboration Center or MCAC according to the newspaper (should probably be MCACC or MCCC)
The article in the Sentinel is called "Little Known Agency Keeps Vital Records" (yeah I know those aren't vital records)

My guess is that the feds are already hitting the panic button.

NM LLC
Having titled my property in a NM LLC
I have decided to possibly sell the place.
My LLC has no existing bank account, what
is my best move here to maintain my privacy. The only way to transfer over the LLC is a cash buyer or I carry the loan right?

You do not need a bank account for the LLC, at least not in any state I know of. I just sold a property last week. I told the woman at the Land Title Company to make out the check in my own name and so she did.

Apartments and the private security business
I currently work in the private security industry and I would like to rent an apartment and stay as anonymous as possible for not only security reasons, but for my safety and the safety of my family. Is there any way to accomplish this if I do not have a nominee?

It would help to know exactly what KIND of work you do in the private security industry. But anyway ...
Find a home, condo, or apartment owned by a private party. Explain to them your work and worries, and (if possible) mention your place of employment. Offer to keep the rent paid six months in advance in return for keeping your identity private and the utility bills in the owner's name (which you will reimburse him for, of course.) If push comes to shove, offer him an extra $100 or $200 a month rent. Others have done this. You can too.

1099s
On page 82 of HTBI you talk about being an independent contractor in order to avoid giving out SSN. I am being asked for SSN to go on 1099...just wondering if I legally have to. I thought 1099 was same thing as independent contractor.
You also mention that anything govt related (which a 1099 is) we shouldnt be too concerned about NOT giving out SSN. Nothing nefarious but just don't want to give out SSN on a 1099 if I don't have to.
Thank you for your excellent ongoing tips.

Give them the SSN. True, you can refuse, but 31 percent will then be withheld. You will also get the one who employed you in trouble which means you will never work for them again!

Land Trusts for privacy & asset protection
Hi,
I own and have read "How to Be Invisible" 3rd Edition. In the text, I can find no mention of land trusts or similar entities. Can you tell me why? While I do understand the benefits of NM LLCs, could you compare the pros and cons of the two entities?
Thanks!

Land trusts vary, are complicated, and IMHO require using a competent lawyer in the field. I don't use them myself because when I buy a vehicle or a property in the name of a New Mexico LLC, I often sell the LLC itself to the buyer--something that cannot be done with a trust. My attorney John Clark forms many trusts--especially for Californians who wish to use an LLC but not get stuck with the $800 franchise fee in your state. (John's email address is on my CONTACTS page.)

Auto retitling
I have a New Mexico LLC from Rosie. I plan to re-title my car. I'm in Texas. It seems the Application for Texas certificate of Title involves some Sales Tax & Use Tax Computation.
The cheapest choices appear to be
1. $5 gift tax with an Affidavit Required
2. Exemption claimed under the Motor Vehicle Sales & Use tax law because__________.
In addition, they want to charge $28 or $33 Application Fee for Certificate of Title.
Additionally, there are tons of rules on line about private party sales and determining value and on and on. I get so disgusted that the state is involved in everything!
Has anyone had these types of issues and how have they been handled or do I just try to register the car in another state?

I can get you WA plates with an address in Alaska or Spain, without filling out the address verification form. However, not the cheapest way to go.

Florida LLC privacy method
The Florida Department of State informs me that they cannot (or will not?) remove the document showing the names of the Manager or Members.
HOWEVER, it was suggested that I simply resign. This will remove my name from their system, even though the original on line document remains.
As they do not require a copy of the Operating Agreement, they will not really know who the active members and managers are.
They do require a yearly renewal where there is an opportunity to edit and or delete information, so I am not sure if you can just delete and leave it at that.

Florida LLC
I have a rental property if Florida, therefore had to register LLC in Florida. I just searched the public records and easily found the information showing the names of the members and everything else, much to my disgust.
I thought about using the NM LLC to be the member, but I am pretty sure they would still require personal information. Is there anything I can do?

I asked my lawyer to read and comment on your question. His answer:
This person may have made a common error--possibly by using a filing service like Legal Zoom, or relying on some registration company, that asks for more information than is required by FL. Or by qualifying the LLC vs forming a wholly owned subsidiary FL LLC. Over at www.privacylawoffice.com, I custom design privacy strategies, tailord to each client's budget, for filing in such states as FL. For the do-it-yourself privacy seeker, file online with FL directly at www.sunbiz.org and make sure you are using or forming a manager-managed FL LLC. As far as I understand (considering I'm not licensed in FL), only the manager is named AND the manager may be another entity However beware that the entity choice and location of the entity might force the "manager entity" to register in FL--which is a no-go for privacy. Try using a trust. A trust that holds the membership interest or a separate trust altogether may be useful. A NM LLC that owns a FL LLC may be okay if ALL management takes place outside FL and the NM LLC does not have offices, employees, etc in FL. I evaluate each client's circumstances and do the research necessary to avoid pitfalls (which are many fold); please do your homework and tread carefully! Business privacy using ANY type of state-chartered entity requires advanced planning and is more difficult than personal privacy. JJ Luna evangelizes personal asset privacy using LLCs but prefers to use a number of other strategies for running low-profile businesses (for which he has publications addressing such issues).

Do others provide same services?
To James, #9553:
European banks won't open accounts for LLCs because of the attentions from the U.S. government this would attract over them. In addition, any bank anywhere will want to know who the actual beneficiary is before opening an account in the name of an entity.
Now my question to Mr. Luna, if I'm not too curious:
Are you connected in any way with [deleted].net? Similar interests, solutions (NM LLC and trust), ebooks, prices. Specifically, my question is whether you and they provide the same LLCs opened by the same incorporator with the same registered agents, or different ones.

I deleted the link to that website due to what I am about to say. The owner is a copycat who thinks he can make some easy money without actually giving the service that Rosie does. I complained to Google once that he was using my name in white letters on his website, so as to grab anyone searching for me. The site was shut down but has since reappeared under the new address.
I once ordered one of his e-books about Canadian banking. He claimed you could open a bank account in Canada with a New Mexico LLC. Totally untrue.
Make your own decision but don't say I didn't tell you to, uh, "watch out."

LLC with foreign bank account
As an non-US citizen, if I were to use a NM LLC ( considered a disregarded entity for tax purposes ) to open an European bank account using apostille. Would this LLC be required to report the existence of this bank account according to the new IRS requirements to report any offshore financial accounts by filing form TDF90-22.1. ?
Or those the disregarded entity make it exempt from this requirement?

As a foreigner, you need not report anything to the American Internal Revenue Service. However, I doubt that you can still open accounts in Europe with an American LLC so be sure and check first with your bank.
