For Larry, SFO: Having manged estates in my family that involved probate court (everything out in public) and did not (no public documents except records of real estate sales, and the death certificate), in my opinion a carefully-documented living trust can be extremely healpful. Living trusts are usually recommended for the potential tax savings (which can be very important), but they also offer your heirs/trustees great freedom in how they handle your estate. Many times I've gone to a bank, real estate agent, stock broker, and been told, "We'll have to see your probate court order," and enjoyed telling the clerk "No court order, this estate is not being probated. Here are the trust documents..."
On the other hand, just try to get a quick response on some action from probate court. In one state I know of, the next opening on the calendar is about 10 weeks out.
With a living trust, you still have to work the system a little to gain the best privacy advantages, but it is possible to do. Not so in probate court.
It is essential to find a good attorney when you create a living trust. Read a couple of the books on living trusts from Nolo Press or whatever is in your public library, and then you will have some good questions to ask a prospective attorney (Avoid those offering free seminars). My experience was three incompetents to one expert.

Now, here is a tacky business. I got a letter from Accelerated Inheritance, LLC in Torrance, CA. Somehow they are notified when Wills are filed for probate. They offer an advance on your inheritance. If your home-address is in the Will, consider it compromised in two ways: 1) it becomes a public record with the filing and 2) it gets put on a mailing list.

#888 10/28/06 Traveling in Campers
Essentially living in a motor home sounds great, but using a full-size truck to pull a camper seems like a bad idea to me.

Truck drivers give up many rights while in their rigs, privacy included. Drivers keep logs of every day, and trucks are monitored much more so than automobiles. Even if you are able to register the rig as a motor home, you will have a hard time flying under the radar.

The only Class 7 or 8 truck in a campground is going to stick out like a sore thumb, and there are many restrictions on trucks. For instance, in my town, a city ordnance forbids driving a truck onto WalMart's parking lot unless you are making a delivery. Calling it a motor home probably won't get you out of a ticket.

Also, it's a crime to skip truck weigh stations, and the trooper that sees you pass it by, jumps into his car and chases you down is probably going to be in a less-than pleasant mood, and might decide a search is necessary.

As a former truck driver, I like the idea of a Freightliner-pulled camper, but when the time comes, we'll be getting a traditional motor home. (Many are on Freightliner chassis, anyway!)

Since I have no experience in the stock market, I cannot give you any expert advice. My uneducated guess, however, is that although a Canadian account might be an improvement over a U.S. account, I doubt that you can use an American LLC in Canada without first registering it there. And the registration process there would be a nightmare.

OK maybe my last question was not very clear. If you place a new mailbox with others at rural location you will be creating a new address/street number this will not be in the USPS database and will apparently be undeliverable. Perhaps however they will attempt physical delivery and if delivered add the address to the database. I wondered if someone had any more information on the technique and if it is still viable? If someone has done this recently please look up your new address and let us know if it comes up as undeliverable.

I was looking into getting an address at a rural location. When I looked up the zipcode of potential addresses at www.usps.com they came back as undeliverable. I know that some places will not even attempt to send something to such an address.

My personal recommendation would be to turn off the XBox! However, Michael Spaulding says:

Phone cards are hit-and-miss. Sometimes the same card will work differently in different parts of the country. (I have had Costco cards that do NOT show the calling number.) The only sure way is to try each card out in the same region where you will be using the card.

For people who already have a Hotmail email account, Hotmail will sell them a $20 per year service ("Hotmail Plus") which provides, among other dubious "benefits", the ability to access their Hotmail account through their Microsoft Outlook email account. Assuming a person purchases this privilege, do you think it would be possible for Microsoft to gain access to personal information about the user through the Outlook account which is in fact, set up through their ISP? I recently had to use the emergency room at my local hospital. In order to be treated, the hospital registration desk insisted on having my social security number, birth date, and wanted a photocopy of my driver's license (no passport allowed). Following HTBI, I asked why they needed such information. They responded "We've never been asked that... our computer screen won't move ahead without it. We can't process you." I then considered giving false info, such as an SSN with the fourth and fifth digits being zeros. But, worried that the system might cross check with my medical insurer (who has my correct info), creating a further problem, I told the truth. Was I intimidated too easily?

Since you have a medical insurer and assuming you do want coverage, you need to furnish the SSN. Just don't give anyone your true home address.

[Edited] I recently lost my wallet. After handling ny credit and debit cards promptly. I went to DMV and they asked for my SS# and 2 thumbprints. I balked and gave in to their insistence. Of course, now I feel pretty dirty (and stupid). I did use a nominee address.

Look again. I have NEVER in my life recommended LLCs from Georgia, for use in other states! For privacy, New Mexico stands alone. However,if someone plans to do business with an LLC, such as buying rental properties, that is another matter. In such a case, (since the LLC may someday wish to file a lawsuit), form the LLC in your own state, whichever state that may be.

I am totally against destroying RFID chips in passports. Why call attention to yourself that way? If you must, wrap the passport in tinfoil but make sure not to do this when going through an airport.

Rental property: You may end up in litigation some day and if so, you need an LLC registered in Georgia. Therefore, you may as well form a Georgia LLC to begin with.

... Bank account.I see no advantage in opening a bank account with an LLC, and therefore never recommend it. If you sign the checks, you will have to furnish both your name and your SSN anyway, so what have you gained?

I have since discovered that most, if not all, insurance companies have measures for domestic violence victims that implement privacy procedures. If the agent contacted does not know about these procedures, one should ask the supervisor. More corporations need to follow suit with such policies. This information may be helpful for your work concerning domestic violence and stalking.

Ok, here is my situation so far: I am getting a New Mexico LLC via the service on your website. This LLC will have my real name and my ghost address in a neighboring state associated with it. I would like to also get the mailing address in Alaska. Now my question is. Can I register my vehicle in the name of the LLC while at the same time giving the Alaska address to the DMV? I'm afraid the DMV clerk's eyeballs will bug out of his head when he sees this and deny my request.

Of course you can use an Alaska address. Explain that the the company is based in Alaska but since the car will be used in Colorado, you are conforming with Colorado law by getting a CO license.
... Dress well, act positive, don't stutter, don't avoid eye contact. BTW, if there is a choice, choose a female clerk. (Women, on the other hand, will do better choosing a male clerk.)

I checked with a CPA. He said your advice was sound to put it into a new non-interest bearing account in the nominee's name. The CPA did advise to write a letter to the nominee that the money being deposited was for payment of debts. He said the letter would substantiate the money as not being 'gift' income if the IRS investigated. It is totally within the law according to him.

I have found that it is not possible to extricate my personal information from all of the databases that exist to collect data on me(credit bureaus, phone records, etc). So I would like to muddy the waters for anybody trying to harvest information on me by submitting false information about myself and letting this incorrect information circulate around thus camouflaging my real data. Do you have any suggestions as to how to effectively mount a personal disinformation campaign?

(1) If I Switch to using a LLC to hold and then sell property, could the IRS audit me and compell a person to take a salery, there by causing social security , and penalty payments due them.


(2) If you do not obtain a fed ID number for the LLC, can you easily deposite a large check that is payable to the LLC into your personal checking account,


(3) Using my ss no. for all accounts is loosing privacy, obtaing and using several business fed numbers has great privacy but many IRS potential problems.




(P.S.) please dont ask me to ask a cpa,, or irs , they dont know, they need to be told how to think.

(1) No. no salary etc., not if you are the sole member of an LLC. Report income on schedule C. (Anyone, of course, can be audited.)

I don't often set aside 46 minutes to watch a video on my computer, but THIS one was fascinating! It deals with police who stop you in the street, on the highway, or knock on your door. Priceless information!

... Although the video is for all ages, it is especially applicable to teens. If you have teens in your home, find the time to have them watch the video. You'll be glad you did.

[Edited for length] I need to re-new my passport (it expires in Nov) so that I can start using that as my ID and not my drivers liscense anymore.

I am wanting to get invisible & have contemplated using my deceased husbands last name. I would have to request my marriage certificate from NV to do this (we were married in 1988 and I never used his last name so it is not tied to me) Should I do this???

I was reading the book. I have a large check (> $10k) of after tax money. I was considering depositing it in a new nominee bank account. My biggest concern is the tax implications. I imagine the nominee will have to pay taxes on it.

Is that the case? Is there another way to keep the money private and not pay tax?

Do not put this money into any account that the nominee is already using. Open a new non-interest-bearing checking account. With no interest reported to the IRS, the account should not be any problem for the nominee. If you are in any doubt, however, check with a CPA or an enrolled agent.

Normally you put future purchases of real estate and vehicles into an LLC. (Not money.) However, you can sell your cars or real estate to an LLC but there may be sales or other taxes payable just as with any other sale in your state.
